Kathleen T. Petrich


Kathleen T. Petrich joined Miller Nash Graham & Dunn as partner in August 2013. Kathleen practices in the area of intellectual property, including mechanical/electrical, electromechanical, design patent, and trademark prosecution. She counsels clients regarding their intellectual property rights and strategizes with clients as to the protection and enforcement of those rights. She also litigates intellectual property disputes, and provides clearing, registration, prosecution, opposition practice, portfolio management, opinion, due diligence, license, and settlement negotiations services. In addition, Kathleen works in the green technology sector, with a special interest in clean transportation.

Representative Experience

Assisted clients in identifying IP objectives in strategic alignment with their business goals, such as: acquiring IP protection for legal competitive advantage; expanding or solidifying an IP portfolio to increase attractiveness for future merger or acquisition; exercising freedom to operate in a particular business industry; acquiring strategic IP holdings for future IP dispute negotiations; and implementing stream of revenue through licensing campaign for acquired IP.
Assisted clients in mining patentable inventions and determining inventorship. Prepared and prosecuted mechanical, electrical, electromechanical, green building, business method, and design patents before the U.S. Patent and Trademark Office. Worked with a network of foreign IP counsel to prepare and prosecute patent applications worldwide.
Assisted clients in determining proper trademark protection. Prepared and prosecuted trademark registrations before the U.S. Patent and Trademark Office and various state governments. Advised clients regarding trademark usage and provided oversight of client marketing materials. Worked with a network of foreign IP counsel to prepare and prosecute trademark applications worldwide. Counseled clients on trade dress and product configuration protection.
Enforced client’s patent, copyright, and trademark rights against infringers through litigation, U.S. Trademark Trial and Appeal Board, or alternative dispute resolution. Defended clients in cases in which others have asserted IP rights. Established and oversaw watch services for client’s IP. Recent litigation matters included representing: a design patent owner of a protective cover for a tablet computer; a financial services provider in trademark disputes; and safety equipment manufacturer in patent infringement suits.
Assisted clients in negotiating and finalizing licensing deals to commercialize IP rights.
