Insurance Recovery

The attorneys on Miller Nash Graham & Dunn's insurance-recovery team represent businesses and individuals both in disputes with insurance companies and in proactively analyzing insurance-coverage and risk-management options. Miller Nash Graham & Dunn's insurance-recovery attorneys have substantial experience in resolving insurance claims involving business interruption and civil authority orders, environmental property damage, construction defect, bodily injury, directors' and officers' liability, theft, professional liability, and products liability. Our team members also have in-depth experience in litigating bad-faith claims, lost-insurance-policy issues, and London-market issues.

Our goal is to maximize each client's insurance recovery in the most cost-effective manner possible. To achieve this goal, our attorneys draw on our deep well of experience in all phases of insurance disputes, including trial when necessary.

In addition to having litigated cases that established new precedent in multiple areas of insurance law, members of our insurance recovery team are also considered leaders in the field and are frequent contributors to The Northwest Policyholder, Miller Nash Graham & Dunn's blog for insurance and related issues in and around the Pacific Northwest. 


Representative Experience

We represent and have represented a number of entities (both private and public) involved in these two large Superfund sites, aggressively pursuing insurance coverage for investigation (defense) and cleanup costs and natural resource damages under historical comprehensive general liability or excess liability policies, as well as marine, environmental-impairment liability, and cost-overrun policies. Our involvement has included litigation at the trial court and appellate levels in state and federal court, as well as extensive behind-the scenes negotiation with domestic and foreign carriers that issued policies to our clients or predecessor entities. In these matters we draw on our "deep bench" that includes attorneys with technical and environmental-law backgrounds and attorneys with experience in complex insurance-coverage disputes involving long-tail risks.
Acting as lead counsel for the Archdiocese of Portland, we recovered more than $75 million from the Archdiocese's insurers after years of litigation involving bodily-injury claims and bankruptcy.
We represent the owner of industrial property in Portland's South Waterfront area in one of the state's longest-running coverage disputes over environmental cleanup costs, which has included multiple appeals and decisions by the Oregon Court of Appeals and Supreme Court on novel issues of policy interpretation, allocation, attorney fees, and other issues.
Our client took an assignment of claims against insurers for roofing contractors on a large school construction project. We obtained complete recovery of more than $2 million, plus fees, after extensive litigation and appeal against the roofing contractor’s excess insurance carrier, and in the process made new law in Oregon on assignment of claims.
We represented a limited liability company in obtaining coverage for a wrongful-death suit arising from a workplace accident, including defeating an insurer's suit to enjoin a court-annexed mediation and escape coverage for alleged failure to cooperate.
