Daniel J. Oates

Dan is a commercial litigation partner whose practice focuses on banking, real estate, trademark, and franchise and distribution litigation. Dan represents financial institutions in commercial and consumer deposit account disputes, lender liability claims, investment disputes, and other matters involving creditors’ rights. His real estate practice includes complex disputes involving residential and commercial real estate transactions. Dan represents trademark registration owners and applicants in disputes with infringing parties and in administrative opposition and cancellation proceedings before the Trademark Trial and Appeal Board. He also has extensive experience in franchise and distribution disputes in a wide variety of industries, including petroleum, heath care, junk removal, restaurant chains, and live action role playing. Dan has published several articles in leading industry and practice publications regarding franchising and distribution.

Dan appears regularly in state and federal court, as well as before administrative bodies, licensing boards, and the Trademark Trial and Appeal Board. In addition, while in law school, Dan externed for the Honorable Marsha J. Pechman, United States District Court Judge for the Western District of Washington. And from 2010-2011, Dan clerked for the Honorable Thomas S. Zilly, United States District Court Judge for the Western District of Washington.

Representative Experience

  • Represented financial advisor in arbitration before Financial Industry Regulatory Authority on unsuitability claims for alternative investments. Obtained complete defense verdict on all claims.
  • Represented franchisor in federal court action to terminate franchise and recover damages from breaching franchisee. Obtained dismissal on summary judgment of franchisee’s statutory and common law counterclaims, and successfully prevailed on termination claims at trial.
  • Defended franchisor in state court action brought by franchisee seeking damages for alleged violations of Washington’s Franchise Investment Protection Act, registration and disclosure violations. Obtained dismissal of franchisee’s claims on summary judgment.
  • Defended franchisor in federal court action brought by franchisee seeking damages for alleged violations of Washington’s Franchise Investment Protection Act, registration and disclosure violations. Obtained dismissal of franchisee’s claims on summary judgment.
  • Defended real estate licensee in state court action seeking damages for misrepresentation and breach of statutory and common law duties. Obtained complete defense verdict following jury trial on the merits.
  • Defended general contractor against claims brought by subcontractor. Obtained favorable award following arbitration.
