Stephen H. Goodman

Senior Counsel

Steve focuses his practice on counseling businesses on environmental and natural resources law. Steve practiced as an environmental engineer before obtaining his law degree, and is a licensed professional engineer in California. He represents clients with natural resource claims and has represented clients before Washington State’s Pollution Control Hearings Board (PHCB), Environmental Protection Agency (EPA), and in state and federal courts. He has negotiated clean up action plans, agreed orders, and consent decrees with EPA and state agencies, including Washington Department of Ecology, Alaska Department of Environmental Conservation, and Oregon Department of Environmental Quality.

Steve’s practice has included defending clients against natural resource damage claims, including claims from a large ammonia release in Dutch Harbor Alaska, claims from alleged selenium releases from a phosphate mine in Southeast Idaho, claims from alleged arsenic and PCB releases to sediment and marine waters in Western Washington, and claims from alleged petroleum releases to sediment and marine and fresh water in Washington and Oregon. Steve is a member of several legal and engineering professional associations, and has lectured on topics of interest to natural resource and environmental professionals.

Representative Experience

  • Represented petroleum refiner on drafting and negotiating EPC contract for construction of major air pollution controls to meet reduced sulfur and nitrogen emission limits.
  • Represented major petroleum refiner drafting and negotiating EPC contract for upgrades to coke production facility at Washington refinery.
  • Drafted and negotiated EPC form contracts for Fortune 500 company for use nationwide.
  • Represented Washington utility related to delay and construction defect claims on EPC contract for 20MW natural gas generation plant in eastern Washington.
  • Represented Washington utility on construction defect claims related EPC contract for 10MW hydrogenation plant in eastern Washington.
  • Represented large processor on drafting E&P and EPC contracts for large processing plant in southwest Washington.
  • Represented petroleum refiner on delay claims on EPC upgrades to co-generation plant at California refinery.
  • Represented chemical manufacturer on claims related to EPC contract for construction of an ethylene-amine plant in Saudi Arabia and recovered in excess of $20 million from EPC contractor.
  • Represented major petroleum refiner on delay and cost overrun claims related to EPC contract to revamp and upgrade refiner’s catalytic reformer at Washington refinery. Claims exceeding $5 million were successfully resolved on summary judgment and settlement.
  • Represented petroleum refiner on product defect claims related to EPC upgrades to Washington refinery.
