Anti-Scalping Lawsuit Update

On April 3, 2008, Judge Marilyn Litzenberger of Multnomah County Circuit Court heard oral argument regarding StubHub's and eBay's motions to dismiss the anti-scalping class-action case. At the hearing, the court instructed the parties to submit additional briefing on a defense raised by StubHub and eBay in which they claim that they are immune from any claims for wrongdoing because of certain provisions of the Communications Decency Act. The parties are now awaiting Judge Litzenberger's ruling as to whether the lawsuit against StubHub and eBay may continue.  We anticipate receiving the court's decision within the next 60 days.
