Anti-Scalping Class-Action Lawsuit Filed |

On January 9, 2008, a class-action complaint was filed against eBay Inc. and its wholly owned subsidiary StubHub, Inc., for their alleged violation of Portland, Oregon's anti-scalping ordinance. The ordinance prohibits the offering for sale of tickets for events at the Rose Garden (or other municipal venues) at a price greater than the original retail price printed on the ticket. The suit seeks injunctive relief and disgorgement of defendants' profits and will seek damages for the class for the last six years. It is presently unknown how many thousands of fans were deprived of a fair opportunity to purchase highly prized tickets over the last six years, but that information will be sought in the lawsuit. Plaintiff sought to purchase premium tickets for the upcoming Bruce Springsteen and the E-Street Band concert on March 28, 2008, but she was unable to procure them from the official ticket outlet when it opened for on-line sales on December 8, 2007. Yet, at virtually the same time, premium tickets appeared for sale on defendants' Web sites at prices far in excess of the original price. This has become a common occurrence, much to the dismay of Springsteen fans, as well as fans of such popular concerts as Hannah Montana. StubHub profits from such sales by charging the seller a 15 percent commission and the buyer a 10 percent commission on the sale of tickets over its Web site.
StubHub has been sued by the New England Patriots for alleged violation of Massachusetts' anti-scalping law in a lawsuit pending in state court there. If you wish to view that complaint, please click the following link:
